Terms of Service
These terms cover what Foundry is, what you can do with the designs it generates, what you agree not to do, and the limits of our liability. Read them before you sign in.
1. Agreement
By creating an account or using Foundry you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the service.
2. Eligibility
You must be at least 13 years old to use Foundry. If you are between 13 and the age of majority in your jurisdiction, you may only use the service with the consent of a parent or legal guardian.
3. Your account
- One account per person. Handles are unique and case-insensitive.
- You are responsible for access to the email address you sign in with. Anyone with access to that inbox can sign in.
- You may delete your account at any time by emailing us. Deletion cascades across all tables keyed to your user ID.
4. Acceptable use
Do not:
- Submit prompts that contain other people's private data, confidential business information, or content you do not have the right to use.
- Try to coerce the generator into producing harmful, illegal, defamatory, or sexually explicit content, or to impersonate real individuals or organizations.
- Abuse the rate limits, create multiple accounts to evade the rolling pair-generation quota, or use automation to submit requests at a rate we have not authorized.
- Reverse-engineer, decompile, or otherwise attempt to extract the underlying prompts, skill definitions, or non-public parts of the service.
- Use a handle that is offensive, impersonates another person, or contains a trademark you do not own.
- Scrape the public profiles of other users, their Taste Cards, or their galleries at scale.
- Use Foundry to generate content that infringes intellectual-property rights, violates export controls, or violates any applicable law.
We may suspend or terminate any account that violates these rules. We may also refuse service or remove content at our discretion.
5. Ownership of what you generate
You own the TSX source code and design output Foundry generates from your prompts. You may use those outputs in personal, commercial, or open-source projects without attribution.
We retain the following, described in more detail in our Privacy Policy:
- The right to store your prompts, generated designs, picks, and feedback in order to operate the service, to build your Taste Card, and to evaluate and improve the design generator. Delete your account to remove your data from both.
- The right to display your Taste Card and pick gallery publicly only when you have enabled the corresponding toggles in Settings.
You warrant that you have the right to submit every prompt you submit, and that your prompts do not violate the rights of any third party. You indemnify Foundry against claims arising from content you submit.
6. AI-generated output
Foundry uses Anthropic's Claude models to generate designs. Output may contain errors, hallucinated text, unusable code, or unexpected aesthetics. Two users submitting the same prompt may receive different results. Output is not reviewed by a human before it is shown to you.
You are responsible for reviewing generated code before using it in production, including for security, accessibility, correctness, and licensing of any assets the model references. Foundry provides no warranty that generated output is fit for any particular purpose.
7. Service availability and quotas
- Foundry is provided on a best-effort basis. We may throttle, degrade, or suspend the service for maintenance, abuse mitigation, or capacity reasons without prior notice.
- A default quota of 25 pair generations per user per rolling 7-day window applies to the free tier. Subscribers to the Hobby plan receive 50 pair generations per rolling 7-day window. Slots free as individual pairs age out of the window; there is no single daily reset. We may change these limits at any time.
- A pair that does not resolve within thirty minutes may be marked expired. Credits consumed by expired pairs are not automatically refunded, because the Claude API call that produced them had a real cost.
8. Third-party services
Foundry depends on Anthropic, Supabase, Railway, and Vercel. Their terms govern the portions of your experience that touch their systems. Outages or changes to those services may affect Foundry. We do not control their policies and are not responsible for their acts or omissions.
9. Disclaimers
Foundry is provided as is and as available, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components, or that any output will meet your requirements.
10. Limitation of liability
To the maximum extent permitted by law, Foundry and its operators will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or loss of goodwill, arising from or in connection with your use of the service — even if we have been advised of the possibility of such damages.
Our aggregate liability for any claim arising from these Terms is limited to one hundred US dollars (US $100), or the amount you have paid Foundry in the twelve months preceding the claim, whichever is greater.
11. Termination
You may terminate your account at any time. We may suspend or terminate your account for violation of these Terms, for extended inactivity, or to comply with a legal obligation. Sections that by their nature should survive termination (ownership, disclaimers, limitation of liability, indemnity, governing law) do so.
12. Changes to these Terms
We may update these Terms. Material changes will be announced by email to account holders at least 14 days before they take effect. Continued use of the service after the effective date constitutes acceptance of the revised Terms.
13. Governing law
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles. Any dispute arising from these Terms will be heard in the state or federal courts located in San Francisco County, California, and you consent to the personal jurisdiction of those courts.
